Terms of Service

1. Parties

These Terms of Service (“Terms”) govern your use of the Klaw platform (“Service”), operated by APPLYZ SAS, a French SAS registered under SIREN 939 867 248, with its registered office at 60 Rue François 1er, 75008 Paris, France (“we”, “us”, “Klaw”).

By creating an account, you agree to be bound by these Terms.

2. Description of the service

Klaw is a cloud platform that allows you to deploy personal AI agents running in isolated containers hosted on Fly.io. The Service operates on a Bring Your Own Key (BYOK) model — you provide your own LLM API keys (Anthropic, OpenAI, xAI, Google). We do not resell or proxy AI model access.

3. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use the Service. By registering, you confirm that all information you provide is accurate.

4. Subscriptions & billing

Each agent requires an active subscription. Plans are billed monthly and renew automatically:

Free trial: New subscribers on the Starter plan receive a 14-day free trial. One trial per user. No charge is made during the trial period. The trial is forfeited if the subscription is cancelled before the trial ends and later restarted.

All payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis. Prices are shown in USD and exclude applicable taxes.

Refund policy: Subscriptions are non-refundable except in cases of technical error attributable to Klaw. You may cancel at any time; your agent will remain active until the end of the current billing period.

5. Acceptable use

You agree not to use Klaw to:

• Violate any applicable laws or regulations
• Send spam, phishing messages, or unsolicited bulk communications
• Perform network attacks, port scanning, or attempt to access systems you do not own
• Generate, distribute, or facilitate illegal content
• Circumvent or exploit the billing system
• Interfere with other users' agents or the platform infrastructure

We reserve the right to suspend or terminate accounts that violate these rules, without prior notice if necessary to protect the platform or other users.

6. Your data & BYOK

You retain full ownership of your data, agent configurations, and any content produced by your agent. You are solely responsible for the LLM API keys you provide and for ensuring you comply with the terms of service of the respective LLM providers (Anthropic, OpenAI, etc.).

Klaw acts as a hosting provider. We are not responsible for the actions, outputs, or decisions of your AI agent.

7. Service availability

We aim to provide a reliable service but do not guarantee 100% uptime. Planned maintenance will be communicated in advance where possible. We are not liable for losses caused by service interruptions outside our reasonable control.

8. Intellectual property

The Klaw platform, branding, and software are the property of APPLYZ SAS. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your own personal or business purposes.

9. Limitation of liability

To the maximum extent permitted by applicable law, APPLYZ SAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the Service.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

10. Termination

You may close your account at any time from the dashboard. Upon termination, all your agents and associated data will be permanently deleted within 30 days.

We may terminate or suspend your account immediately if you breach these Terms or if we are required to do so by law.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing law & disputes

These Terms are governed by French law. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer protection laws in your country of residence provide otherwise.
